CGV - General Sales Conditions

2. Scope of application

These terms and conditions govern the sale of handcrafted objects and artistic creations on the Castagnina.com website, accessible to all private and professional customers, for delivery worldwide or by hand in Corte, Haute-Corse.

3. Products

  • Each item sold is unique or produced in small series. Photographs and descriptions are as accurate as possible, but have no contractual value.
  • The materials used and any variations (colors, textures) are explained in the product data sheets.

4. Control

  • Validation of the order implies full acceptance of these terms and conditions.
  • The seller reserves the right to cancel or refuse any order from a customer with whom there is a previous dispute.

5. Awards

  • Prices are quoted in euros, inclusive of all taxes, and exclude delivery charges.
  • For deliveries outside the European Union, customs duties or other local taxes may be payable by the customer.
  • The seller reserves the right to modify its prices at any time; the applicable price is that indicated when the order is validated.

6. Payment

  • Secure credit card payment via Stripe.
  • The order is considered effective upon receipt of full payment.

7. Delivery

  • Delivery possible to any country in the world.
  • Delivery methods: shipment by carrier, post, or hand delivery in Corte (Haute-Corse) by appointment.
  • The seller is not responsible for delays caused by the carrier or by customs formalities.
  • Delivery costs are specified before the order is validated.
  • On receipt, the customer must check the integrity of the package. Any complaint must be made within 48 hours, with a reasoned reservation to the carrier.

8. Right of withdrawal

  • In accordance with French legislation (article L.221-18 of the Consumer Code), the individual customer has 14 days from receipt of the product to exercise his right of withdrawal, without having to justify his decision.
  • The right of withdrawal does not apply to personalized items or items made to order.
  • Return shipping costs are at the customer's expense. Refunds will be made upon receipt of the returned product in new condition or as sold.

9. Claims and warranties

  • Products are covered by the legal guarantee of conformity and the guarantee against hidden defects in accordance with articles L.217-4 et seq. of the French Consumer Code and 1641 et seq. of the French Civil Code.
  • In the event of a proven defect, the product may be exchanged or refunded.

10. Liability

  • The seller is not responsible for misuse or normal wear and tear of the items sold.

11. Personal data

  • The personal information collected is used solely to manage orders and is never passed on to third parties for commercial purposes.
  • The customer has a right of access, rectification and opposition in accordance with the RGPD (General Data Protection Regulation).

12. Intellectual Property

  • The creations, photos, texts and all content of the site remain the exclusive property of the seller and may not be used without prior authorization.

13. Applicable law & Disputes

  • The GCS are governed by French law.
  • In the event of a dispute, an amicable settlement will be sought as a matter of priority. Failing this, the competent court will be that of the defendant's place of residence or the place of delivery.
